Boulder School for German Language and Culture
Terms of Service as of June 2023

The Boulder School for German Language and Culture was formed to instruct both Children and Adults in German language and culture. The school is within the jurisdictions of the City and County of Boulder and the state of Colorado and follows the laws of these jurisdictions. Class Attendance

To attend a class or cultural event, the student or student’s parent will sign up using a third- party service called Jackrabbit. A link is provided to Jackrabbit for each class on the school’s website at bouldergermanschool.org when signing up for a class. The school requires both an Accident Waiver and COVID Risk Waiver be acknowledged to take a class. 

Our classes are held in-person or online. In-person classes are currently being held at Atonement Lutheran Church

Class Payments

Payment for a class or book is due in full at time of registration. Your credit card will be charged for the full amount due within 48 hours of registration submission.

  • If you or your child are attending private classes, you must contact the registrar to be assigned to a teacher. The registrar will take payment at the time of registration. You may also approve automatic recurring payments to be made from your credit card.

  • If your child is attending a preschool class, you agree to a recurring payment being charged to your credit card monthly while your child is attending classes.

  • Contact the registrar to set up recurring payments.

Class Cancellations and Refunds

If the required number of students have not registered by the first day of each term, we reserve the right to cancel or combine classes. If the class is canceled, you will be informed accordingly prior to the start of the class and 100% of any fees collected will be refunded. If the school combines classes and changes the date/time, the student may request a full refund if they cannot attend the new date/time.

A refund for reasons other than the above will be provided if the student requests the refund 7 or more days before the class starts by emailing the school’s registrar and requesting the refund. A $50 cancellation fee will be deducted from the refund. No refunds will be provided within 6 days of the class start date.

Teacher’s may from time-to-time need to cancel and reschedule a class. The Teacher will work with the students or a student’s parents to find an agreeable time for students to attend a make-up class. The school reserves the right to provide a substitute teacher as needed. In the unlikely event that the class cannot be made-up, the school may provide a refund for the one class missed.

Students that miss a class that is outside the control of the school may request from the Teacher materials for the missed class. No refunds will be provided for a student missing a class. We also do not prorate the cost of a class if a student plans to miss a class.

In-person Summer Camp Cancellation / Refund Policies

  • If the school needs to cancel a camp prior to the start of a camp, families will receive a 100% refund.

  • If the school needs to cancel a portion of the camp that has already started families will receive a 100% refund of the unused portion of the camp.

  • If a child cannot attend a camp, cancellation must be made at least two weeks prior to the session’s start date for a full refund minus a $50 administration fee.

  • Cancellations made one week prior to camp start date are subject to a 50% cancellation fee, Cancellations made less than one week prior to camp start date are subject to a 75% cancellation fee.

Assessments

For Adult learners, an assessment may be requested if you are unsure which class is best for you. The fee as of December 2022 will be $50 for a private assessment with the prices subject to change. The student can attend one class within 6 weeks of the assessment based on the teacher’s recommendation for which class level to attend and apply the $50 towards the next 5 or 6-week class offered at that level. No refunds are available. Contact our registrar for help in signing up for an assessment.

Inclement Weather

The School follows the Boulder County School District’s policy for closing due to inclement weather.    Teacher’s will work with students or their parents to find an agreeable time for students to attend the make-up class if the school must close for inclement weather. In the unlikely event that the class cannot be made-up, the school may provide a refund for the one class missed.

Accident Waiver and Release:

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, or because of their possible liability without fault.

In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns to INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons involved with the Boulder School for German Language and Culture from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

I acknowledge that the school and its directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

I understand while participating in this activity, participants may be photographed. I agree to allow any such photos, videos, or film likenesses to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns, including, but not limited to, Social Media, e.g. Facebook, Instagram, Twitter, and/or YouTube; and Websites, e.g. www.bouldergermanschool.org.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

Assumption of the Risk and Waiver of Liability Relating to COVID

Examples of the current Accident Waiver and Release, Cancellations and Refunds, and Assumption of the Risk and Waiver of Liability Relating to COVID are part of our registration process. They are provided below so you can review these before registering for a class.

The novel coronavirus COVID-19 has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing. Additionally, during this time many governments prohibited the congregation of groups of people often in excess of ten people, but even going so far as to prohibit any meetings of people who were not related or lived in the same dwelling. The Boulder School for German Language and Culture have put in place preventative measures to reduce the spread of COVID-19; however, The Boulder School for German Language and Culture cannot guarantee that you or your children will not become infected with COVID-19. Further, participation in summer camp programs could increase your risk of contracting COVID-19.

Read Carefully before agreeing
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I or my child(ren) may be exposed to or infected by COVID-19 by participation; and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that there is a risk of becoming exposed to or infected by COVID 19 at the Boulder School for German Language and Culture Camps.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury or illness to myself or my child(ren) (including, but not limited to, personal injury, disability, and death). Illness, loss, claim, or expense, of any kind, that I may experience or incur in connection with my participation at The Boulder School for German Language and Culture Classes. On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless Boulder School for German Language and Culture, Inc., its contractors (teachers), board members, and volunteers, whether a COVID-19 infection occurs before, during, or after participation at the Boulder School for German Language and Culture Classes.

By signing this document, I agree that if I or my child(ren) are exposed or infected by COVID-19 during my participation in this activity, then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being released on the basis of any claim for negligence.

I agree that to the best of their ability my child(ren) will follow all class safety guidelines laid out by the Boulder School for German Language and Culture.
